CANCELLATION AND REFUND POLICY
M.S.J. & K. Inc.
Effective Date: September 22, 2026
This Cancellation and Refund Policy is incorporated into, and forms part of, the Terms of Service between M.S.J. & K. Inc. ("Company") and Customer. PLEASE READ IT BEFORE PURCHASING. IT STATES THAT PURCHASES ARE FINAL AND NON-REFUNDABLE.
1. All Sales Are Final
1.1 No Refunds TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL FEES PAID TO COMPANY ARE NON-REFUNDABLE, NON-CANCELABLE ONCE CHARGED, AND NON-CREDITABLE. THIS APPLIES TO ALL AMOUNTS OF EVERY KIND, INCLUDING WITHOUT LIMITATION SUBSCRIPTION FEES, RENEWAL FEES, ONE-TIME FEES, SETUP FEES, USAGE-BASED FEES, PER-FEATURE FEES, AI-ASSISTED FEATURE FEES, DATA IMPORT OR CONVERSION FEES, STORAGE FEES, AND ANY OTHER AMOUNT PAYABLE UNDER THE TERMS OF SERVICE, WHETHER OR NOT SPECIFICALLY ENUMERATED IN THIS POLICY.
1.2 No Partial Periods NO REFUND, CREDIT, PRORATION, OR OFFSET IS PROVIDED FOR ANY UNUSED PORTION OF A BILLING PERIOD, FOR ANY PERIOD DURING WHICH CUSTOMER DID NOT USE THE SERVICES, FOR ANY FEATURE CUSTOMER DID NOT USE, OR FOR ANY ACCOUNT THAT IS CANCELED, SUSPENDED, OR TERMINATED FOR ANY REASON.
2. Situations That Do Not Give Rise to a Refund
2.1 Non-Exhaustive List Without limiting Section 1, no refund or credit is available on account of: Customer's cancellation; Customer's dissatisfaction with the Services; Customer's failure to use the Services; suspension or termination of the account by Company under Section 17 of the Terms of Service; a change to, or discontinuation of, any feature, function, or component of the Services; downtime, interruption, degradation, defect, error, or unavailability of any kind; the accuracy, completeness, or suitability of any report, calculation, or AI Feature output; the acts, omissions, availability, pricing, or discontinuation of any third-party service, financial institution, data aggregator, payment processor, or artificial-intelligence provider; loss, corruption, or unavailability of data; Customer's failure to cancel before a renewal date; or any other circumstance not expressly identified in Section 3.
3. Limited Exceptions
3.1 Required by Law Company will provide a refund only where, and only to the extent, a refund is required by applicable law that cannot be waived by agreement. NOTHING IN THIS POLICY WAIVES, LIMITS, OR EXCLUDES ANY RIGHT OR REMEDY THAT APPLICABLE CONSUMER PROTECTION LAW CONFERS ON CUSTOMER AND THAT CANNOT LAWFULLY BE WAIVED. Where any provision of this Policy is unenforceable as applied to a particular customer or jurisdiction, it is modified to the minimum extent necessary to make it enforceable, and the remainder of this Policy continues in full force.
3.2 Duplicate or Erroneous Charges Where Company determines, in its sole discretion, that a charge was a duplicate or the result of a demonstrable billing error by Company, Company will reverse the incorrect portion of that charge. A claim under this Section must be made within thirty (30) days of the charge in accordance with Section 7 of the Subscription and Billing Terms.
3.3 Feature Never Delivered Where Customer has paid a separate one-time fee for a specific feature or service and Company does not deliver it at all - as distinct from delivering it with an outcome Customer is dissatisfied with, or with an interruption, defect, or inaccuracy of any kind - Company will refund that fee or, at Customer's election, apply it as a credit. This Section does not apply where the feature was made available to Customer and Customer did not use it, where delivery failed because of Customer's own act, omission, data, or configuration, or where Customer's access was suspended or terminated under Section 17 of the Terms of Service.
3.4 Discretionary Company may, in its sole and absolute discretion, issue a refund or credit in any individual case, and may condition it on immediate termination of the subscription, on the closure of the account, on the return or deletion of anything obtained with the refunded amount, or on any other reasonable condition Company specifies at the time. Doing so is not an admission of any obligation, creates no course of dealing, sets no precedent, and does not entitle Customer or any other customer to a refund or credit on any other occasion.
4. Cancellation
4.1 Effect Customer may cancel at any time as described in the Subscription and Billing Terms. Cancellation stops future renewals. It does not reverse, refund, or credit any amount already charged, and it does not shorten the period already paid for.
4.2 What Cancellation Does Not Do CANCELLING A SUBSCRIPTION DOES NOT CANCEL, RECALL, REVERSE, OR REFUND ANY PAYMENT MADE BY A TENANT OR OTHER PAYER, which is governed by Section 29 of the Terms of Service and by Customer's own merchant agreement. It does not cancel any payment authorization a payer has given, which must be revoked through the mechanism described in Section 29.3 of the Terms of Service; it does not disconnect Customer's merchant account, which Customer must do itself; it does not stop or withdraw any information already furnished to a consumer reporting agency under Section 30 of the Terms of Service; and it does not terminate any lease, tenancy, vendor engagement, or insurance policy. Customer remains solely responsible for each of those, and for exporting its own records within the window described in Section 11 of the Data Processing Addendum.
5. Promotional Purchases
5.1 General Amounts discounted or waived by a promotional code have no cash value and are not refundable, redeemable, or exchangeable for cash or credit under any circumstances.
6. Chargebacks
6.1 General Customer agrees to raise any billing concern with Company first, as required by Section 7 of the Subscription and Billing Terms. Initiating a chargeback or payment reversal in place of that process is a material breach of the Terms of Service and may result in immediate suspension or termination.
7. Basis of the Bargain
7.1 General Customer acknowledges that this Policy is a fundamental basis of the bargain between the parties and that the fees charged for the Services reflect the allocation of risk set forth in this Policy, in Section 18 (Disclaimers) and in Section 20 (Limitation of Liability) of the Terms of Service.
